No Guaranteed Results

While we use proven systems and best practices, we cannot guarantee specific business outcomes including:

• Number of leads

• Evaluations booked

• Athlete enrollments

• Revenue

• Advertising performance

Business results depend on many factors outside our control including pricing, competition, staff responsiveness, advertising budget, and market conditions.

Client Responsibilities

Clients agree to:

• Provide accurate information

• Maintain access to required accounts

• Respond promptly during implementation

• Review and approve advertising when required

• Follow recommendations where appropriate

Payments

Unless otherwise agreed in writing:

• Monthly service fees are billed in advance.

• Performance bonuses are billed according to the agreed pricing structure.

• Advertising spend is paid directly by the client to the advertising platform unless otherwise specified.

Late or missed payments may result in suspension of services.

Intellectual Property

All systems, workflows, automations, templates, documentation, and proprietary processes created by Kinetik Ops remain the intellectual property of Kinetik Ops unless otherwise agreed in writing.

Clients receive a license to use deliverables during the service relationship.

Limitation of Liability

To the fullest extent permitted by law, Kinetik Ops shall not be liable for indirect, incidental, or consequential damages arising from the use of our services.

Confidentiality

We treat client information as confidential and will not disclose proprietary business information except where required by law.

Termination

Either party may terminate services according to the agreement between Kinetik Ops and the client.

Outstanding balances remain due upon termination.

Changes

We reserve the right to modify these Terms at any time. Continued use of our website or services constitutes acceptance of any updated Terms.
